Agreement to these terms

These Terms of Service govern your access to and use of the websites, applications, assessment kits, reports and related services (together, the “Services”) offered by Futurist Health (“Futurist”, “we”, “us”). By creating an account, booking a consultation, or using any part of the Services, you agree to these Terms. If you do not agree, do not use the Services.

What the Services are — and are not

Futurist provides muscle health measurement, reporting and educational information. We coordinate imaging at third-party partner clinics, supply at-home assessment equipment, compute summary scores from your measurements, and arrange review of your report by a licensed clinician.

The Services do not diagnose, treat, cure or prevent any disease. We do not prescribe medication, do not advise on GLP-1 or any other prescription dosing, and do not provide emergency care. Nothing in a Futurist report replaces the judgement of your treating physician. If you believe you are experiencing a medical emergency, contact your local emergency number immediately.

Eligibility

You must be at least 18 years old and legally able to enter into a contract. Some assessments are not appropriate during pregnancy, with certain implanted devices, or with acute injury; you agree to disclose relevant conditions during intake and to follow any exclusions your clinician identifies.

Assessments, equipment and physical risk

The functional assessment involves physical exertion, including grip, balance, jump and repetition tasks. Physical activity carries inherent risk of injury. You agree to perform each task only as instructed, to stop if you feel pain, dizziness or distress, and to consult your physician before starting if you have any condition that makes exertion unsafe. You assume responsibility for performing assessments in a safe environment.

Equipment supplied to you remains our property unless stated otherwise at purchase, must be used only as instructed, and must be returned in working order on request or on cancellation where the plan requires it.

Third-party clinics and providers

Imaging, laboratory work and clinical consultations may be delivered by independent providers. Those providers are solely responsible for the professional services they render and for their own licensure, standards of care and records. Futurist facilitates scheduling and data handling; it does not practise medicine and is not liable for the acts or omissions of independent providers.

Memberships, fees and cancellation

Membership scope and price are confirmed in writing before you are charged. Unless stated otherwise at checkout, memberships are billed annually in advance and renew automatically until cancelled. You may cancel renewal at any time before the renewal date; cancellation takes effect at the end of the paid term. Fees for services already delivered — including scans performed and kits shipped — are non-refundable except where required by law.

Your data

Our handling of health and personal information is described in our Privacy Policy, which forms part of these Terms. You retain ownership of your health information. You grant us a licence to process it to deliver the Services, and — only where you give separate, revocable consent — to use de-identified, aggregated data to improve our models and reference ranges. You may request access, correction, export or deletion of your data as described in the Privacy Policy.

If you connect a wearable or upload third-party results, you confirm you are authorised to share that data with us.

Acceptable use

You agree not to misrepresent your identity or health history, share your account, resell or commercially redistribute reports, reverse-engineer our scoring, scrape the Services, or use them to provide clinical services to third parties without a written partner agreement.

Intellectual property

The Services, including our scores, models, report designs, software and brand, are owned by Futurist or its licensors. We grant you a limited, personal, non-transferable licence to use the Services and your own reports for personal, non-commercial purposes, including sharing them with your own clinicians.

Disclaimers and limitation of liability

Except where prohibited by law, the Services are provided “as is” and “as available”, without warranties of any kind, including fitness for a particular purpose or that measurements will be error-free or clinically conclusive. To the maximum extent permitted by law, Futurist is not liable for indirect, incidental, special or consequential damages, and our total aggregate liability arising from the Services is limited to the amount you paid us in the twelve months preceding the claim. Nothing here excludes liability that cannot lawfully be excluded, including for death or personal injury caused by negligence.

Suspension and termination

We may suspend or terminate access if you breach these Terms, if required for safety or legal reasons, or if we discontinue the Services. You may stop using the Services at any time. Provisions on data, intellectual property, disclaimers, liability and dispute resolution survive termination.

Changes, governing law and disputes

We may update these Terms; material changes will be notified before they take effect, and continued use constitutes acceptance. These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. Disputes will be resolved in the state or federal courts located in Delaware, unless applicable consumer-protection law entitles you to bring proceedings in your place of residence.
